10 Right of withdrawal

10.1 The user who holds the quality of consumer has the right to withdraw from the contract concluded with LUNGOLIVIGNO, without incurring costs other than those provided for in this article and without having to specify the reason, within fourteen (14) calendar days ( Withdrawal Period ). The Withdrawal Period expires after 14 days:

1. a) in the case of an order relating to a single Product, from the day on which the user or a third party, other than the carrier and designated by the user, acquires physical possession of the Product;
2. b) in the case of a Multiple Order with separate deliveries, from the day on which the user or a third party, other than the carrier and designated by the user, acquires physical possession of the last Product; or
3. c) in the case of an order for the delivery of a Product consisting of multiple lots or pieces, from the day on which the user or a third party, other than the carrier and designated by the user, acquires physical possession of the last lot or piece .

10.2. To exercise the right of withdrawal, the user must inform LUNGOLIVIGNO of his decision to withdraw, before the expiry of the Withdrawal Period.

10.3 To this end, the user can:

(a) use the standard withdrawal form ( Withdrawal Form ) made available to you on the Site, through a specific link, before the conclusion of the contract, and, in any case, through the “Right of Withdrawal” link, present in the footer Site and attached to the shipment confirmation e-mail; or

(b) submit any other explicit declaration of your decision to withdraw from the contract ( Declaration of Withdrawal ).

The Standard Withdrawal Form or the Withdrawal Declaration must be sent to the following addresses: Lungolivigno Spa, via E. Besana n. 7 (20122), Milan; e-mail: recesso@lungolivigno.com.

10.4 The user has exercised his right of withdrawal within the Withdrawal Period if the communication relating to the exercise of the right of withdrawal is sent by the consumer before the expiry of the Withdrawal Period. In the event that the user makes use of the Declaration of Withdrawal, he is invited to indicate in the Declaration of Withdrawal the order number, the Product (s) for which he / she intends to exercise the right of withdrawal and the his address. Since the burden of proof relating to the exercise of the right of withdrawal before the expiry of the Withdrawal Period rests on the user, it is in the user’s interest to use a durable medium when communicating to LUNGOLIVIGNO its withdrawal.

10.5 In case of withdrawal, for the return of the Product, the user can use a carrier of his choice: in this case, the user, after having exercised the right of withdrawal in the manner indicated in articles. 10.3 and 10.4 above, he must return the Product to LUNGOLIVIGNO, using the carrier (at his own expense), without undue delay and in any case within 14 calendar days from the date on which he communicated his decision to LUNGOLIVIGNO. to withdraw. The deadline is met, if the user returns the Product before the expiry of the fourteen-day period. The Product, properly protected and packaged, must be sent to the following address: Grand Hotel della Posta, Piazza Garibaldi Giuseppe, (23100) Sondrio (SO).The direct costs of returning the Product to LUNGOLIVIGNO are borne by the user . The return of the Product to LUNGOLIVIGNO takes place under the responsibility of the user; the Product is considered returned when it is delivered to the carrier.

10.6 If the user withdraws from the contract, LUNGOLIVIGNO will refund the Total Amount Due paid by the user for the Product, including delivery costs, if applicable, without undue delay and in any case no later than 14 calendar days from the in which LUNGOLIVIGNO was informed of the user’s decision to withdraw from the contract; the relative return costs and the import costs paid to the Italian customs and not recoverable are excluded. The refund will be made using the same payment method used by the user for the initial transaction; in any case, the user will not have to incur any costs as a consequence of this reimbursement.

The refund may be suspended until receipt of the Products or until the user demonstrates that he has returned the Products, whichever is earlier.

In the case of goods which by their nature cannot normally be returned by post, the estimated cost of returning such Products will be indicated in the Standard Instructions on Withdrawal. The Standard Instructions on Withdrawal, containing information on exercising the right of withdrawal, are made available to the user on the Site, before the conclusion of the contract, through a specific link and through the “Right of Withdrawal” link, present in the footer of the Site as well as attached to the shipment confirmation e-mail.

10.7 In the event of partial withdrawal, the amount of the delivery costs to be returned to the user following the withdrawal will be calculated as indicated in art. 10.12 below.
